Terms & Conditions

These Terms govern the use of Mountain Race Shop™ software tools, including the Shim Calculator and associated engineering applications (“Tools”). By accessing or using the Tools, you agree to these Terms. If you do not agree, you must not use the Tools.

1. Provider

These Tools are operated by Fenian Park Trading Pty Ltd, trading as Mountain Race Shop™, Australia.

2. Nature of the Tools

The Tools provide engineering-based calculations, modelling, and decision-support outputs intended for professional users.

The Tools:

• Assist technical judgment — they do NOT replace it
• Provide estimates only
• Require professional validation and real-world testing
• Must be used by suitably skilled persons

3. No Warranty

All Tools are provided “as is” without warranties of any kind. Mountain Race Shop™ makes no guarantees regarding:

• Accuracy under all operating conditions
• Mechanical suitability
• Performance outcomes
• Safety results
• Fitness for a particular purpose

Use of the Tools is entirely at your own risk.

4. Professional Responsibility

You acknowledge that:

• Suspension tuning is highly application-specific
• Incorrect setup can cause equipment failure, injury, or death
• All final engineering decisions remain the user’s responsibility

You must perform appropriate testing before operational use.

5. Limitation of Liability

To the maximum extent permitted by law, Fenian Park Trading Pty Ltd shall not be liable for any:

• Mechanical failure
• Loss of control
• Crash damage
• Personal injury
• Death
• Business loss
• Indirect or consequential damages

Liability is limited to the amount paid for the subscription in the preceding 12 months.

6. Subscription & Payments

• Subscriptions renew automatically via PayPal
• You may cancel at any time through PayPal
• No partial refunds are provided for unused time
• Pricing may change for future billing periods

7. Intellectual Property

All software, calculations, models, algorithms, branding, and content remain the exclusive intellectual property of Mountain Race Shop™.

You may NOT:

• Copy the software
• Reverse engineer
• Resell access
• Create derivative tools
• Share login access

8. Acceptable Use

You agree not to use the Tools for:

• Illegal activities
• Unsafe mechanical applications
• Military use
• Autonomous vehicle control

9. Termination

We reserve the right to suspend or terminate access for misuse without refund.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
